Somewhere in the Mitsubishi documentation I saw a reference that stated the battery is not a maintenance item expected to be replaced, specifically it said that it is expected that the battery retains 80% of capacity for the life of the vehicle (maybe 8 or 10 years). It is an "expectation", not a warranty of any kind!
Mitsubishi are also saying quite clearly that the battery capacity WILL diminish depending on time and usage.
That's just stating the bleeding obvious with the current state of the technology.
My guess is that if your battery suddenly drops 50% because of a bad cell (which would be detected by the BMU), it would be a warranty issue. If the capacity dropped over a period of time and all cells are performing similarly, then it would be considered fair wear.

Having said all this, the PHEV would still be perfectly usable as a hybrid and short range EV commuter even if the battery capacity dropped to 50%, as long as it is not due to one or a few bad cells.

that's pretty much what I was saying above - an eight year old PHEV will still compete well enough with an RX450h provided the battery capacity simply degrades rather than fails completely. I already use mine pretty much the same as I would an RX450h - the additional battery capacity of the PHEV is not enough to make much difference to my running costs for my pattern of usage.
